1. Who we are
Zynlo is an email marketing service for online stores provided by Mario Portilho, Portugal ("we", "us"). These terms apply to anyone who creates an account ("you").
2. Your account
You must give accurate information, keep your password safe and be at least 18 years old. You are responsible for everything done through your account, including by users you invite.
You may only use the service for a business, not as a consumer.
3. Plans and payment
The Free plan is free of charge within its limits. Paid plans are billed monthly in advance through Stripe, in euros, plus VAT where applicable.
If you exceed your plan's limits, sending pauses until you upgrade or the next month starts. We may change prices with at least 30 days' notice by email; the new price applies from your next billing period.
You can cancel at any time from the billing page. Cancellation takes effect at the end of the paid period and is not refunded pro rata, except where the law requires it.
4. Your content and your contacts
You keep all rights to your content and to the personal data of your contacts. You give us permission to store and process it only to provide the service.
You are the controller of your contacts' personal data and we are your processor. Our Data Processing Agreement forms part of these terms.
5. Rules for sending
You must only email people who gave you valid consent or where another legal basis applies, include a working unsubscribe link and your postal address, and follow our Acceptable Use Policy.
To protect deliverability for all customers, we apply sending limits to new accounts and may pause or suspend an account with high bounce or complaint rates, or that breaks these rules. Where possible we will tell you first.
6. Availability and support
We work to keep the service available but do not guarantee it will be uninterrupted. Support is by email at the support address published on our website.
7. Liability
The service is provided as is. To the extent the law allows, we are not liable for indirect losses or lost profits, and our total liability in any 12-month period is limited to the amounts you paid us in that period. Nothing limits liability that cannot be limited by law.
8. Ending the contract
You can close your account at any time. We may end these terms with 30 days' notice, or immediately for a serious breach. After closure, we delete your data within 30 days unless the law requires us to keep it, and you can export your contacts before then.
9. Changes and law
We may update these terms and will email you about material changes at least 30 days in advance. These terms are governed by Portuguese law and the courts of Portugal have jurisdiction, without affecting any mandatory rights you have.
